2. General

I process personal data only where this is necessary to provide this website and the services offered here, or where you have given your consent. Depending on the case, the legal basis is Art. 6 (1) (a) GDPR (consent), (b) (contract or pre-contractual steps), (c) (legal obligation) or (f) (legitimate interest).

 

3. Hosting

This website is hosted by Wix. The provider is Wix.com Ltd., with its European establishment Wix Online Platform Limited, 1 Grant's Row, Dublin 2, Ireland. When you open the site, data is automatically transmitted to Wix servers and stored there in log files:

  • IP address

  • date and time of access

  • page requested

  • volume of data transferred

  • referrer URL

  • browser type and operating system

The legal basis is Art. 6 (1) (f) GDPR. My legitimate interest lies in the secure and stable operation of the website. A data processing agreement is in place with Wix. 4. Cookies

This website uses cookies that are technically necessary for its operation, for example so that forms work and security functions apply. The legal basis is § 25 (2) TDDDG together with Art. 6 (1) (f) GDPR.

Cookies that are not necessary, such as those used to measure reach, are set only with your consent. You can give that consent through the cookie notice on this site and withdraw it at any time with effect for the future.

 

5. Getting in touch

If you write to me through the contact form or by email, I process your name, your email address and the content of your message in order to answer it. The legal basis is Art. 6 (1) (b) GDPR where the enquiry concerns a contract, otherwise Art. 6 (1) (f) GDPR. I delete the data once the enquiry has been dealt with, unless statutory retention periods apply.

 

6. Free Day Master analysis and emails

When you request the free analysis, I process your first name, your email address and the Day Master you selected. I use this to send you the analysis as a PDF and, from time to time, texts and offers on the subject of timing.

The legal basis is your consent under Art. 6 (1) (a) GDPR. You can withdraw it at any time without affecting the lawfulness of processing carried out until then. The unsubscribe link at the end of every email is enough, or a message to hello@maryannhaack.com. After withdrawal I remove your data from the list.

Sending and administration run through the functions provided by Wix. Your sign-up is logged so that it can be evidenced in case of dispute. The legal basis for this is Art. 6 (1) (f) GDPR.

 

7. The free calculators on this website

This website offers several calculators in which you can enter your date, time and place of birth. These entries are processed entirely in your browser. They are not transmitted to me and not stored on any server. Once you close the page, they are gone.

There is one exception: the place search in the BaZi Chart Generator. Your entry is sent to the Nominatim service operated by the OpenStreetMap Foundation, St John's Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom, in order to look up the coordinates of that place. Your IP address is transmitted as part of this. The legal basis is Art. 6 (1) (f) GDPR; my legitimate interest lies in the correct calculation. More: https://osmfoundation.org/wiki/Privacy_Policy

 

8. Payments

For paid services I use the payment provider Stripe. The provider for Europe is Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland.

When you complete a purchase, you enter your details directly with Stripe. These include your name, email address, payment details and, for the personal analysis, your date, time and place of birth. Stripe passes on to me the information I need in order to provide the service and to keep my books; I do not receive full card details.

9. Booking appointments

I use Cal.com for scheduling appointments. The provider is Cal.com, Inc., 2261 Market Street #4382, San Francisco, CA 94114, United States. When you book an appointment, your name, email address, the chosen appointment and the information you enter in the booking form are processed, in particular your date, time and place of birth and your questions. The legal basis is Art. 6 (1) (b) GDPR. More information: https://cal.com/privacy

 

10. Online sessions

Conversations and course sessions take place via Zoom. The provider is Zoom Communications, Inc., 55 Almaden Boulevard, Suite 600, San Jose, CA 95113, USA. Your name, email address, connection data and audio and video during the session are processed. The legal basis is Art. 6 (1) (b) GDPR. Data is transferred to the USA; Zoom is certified under the EU-US Data Privacy Framework and additionally relies on the standard contractual clauses. 11. Retention

I keep personal data only for as long as it is needed for the purpose in question, and delete it afterwards unless statutory retention periods apply. Invoices and accounting records are subject to the commercial and tax retention periods of six and ten years respectively.

 

12. Your rights

You have the right to information about the data held about you, to have inaccurate data corrected, to erasure, to restriction of processing and to data portability. You may object at any time to processing based on Art. 6 (1) (f) GDPR. Any consent given can be withdrawn at any time with effect for the future.

You also have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for me is the Bavarian Data Protection Authority, Promenade 18, 91522 Ansbach, Germany.

 

13. No automated decision-making

There is no automated decision-making, including profiling, within the meaning of Art. 22 GDPR.

 

14. Changes

I update this privacy policy when the services offered or the legal position change. The version published on this page is the one that applies.

Ich verarbeite personenbezogene Daten nur, soweit das für die Bereitstellung dieser Website und der angebotenen Leistungen erforderlich ist oder soweit Sie eingewilligt haben. Rechtsgrundlagen sind je nach Fall Art. 6 Abs. 1 lit. a DSGVO (Einwilligung), lit. b (Vertrag oder vorvertragliche Maßnahmen), lit. c (rechtliche Verpflichtung) und lit. f (berechtigtes Interesse).

 

3. Hosting und Bereitstellung der Website

Diese Website wird bei Wix gehostet. Anbieter ist die Wix.com Ltd. mit europäischer Niederlassung Wix Online Platform Limited, 1 Grant's Row, Dublin 2, Irland. Beim Aufruf der Website werden automatisch Daten an die Server von Wix übermittelt und dort in Server-Logfiles gespeichert:

  • IP-Adresse

  • Datum und Uhrzeit des Zugriffs

  • aufgerufene Seite

  • übertragene Datenmenge

  • Referrer-URL

  • Browsertyp und Betriebssystem

Diese Verarbeitung erfolgt auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO. Mein berechtigtes Interesse liegt im sicheren und stabilen Betrieb der Website. Mit Wix besteht ein Auftragsverarbeitungsvertrag. Soweit Daten außerhalb der EU verarbeitet werden, stützt Wix dies auf die Standardvertragsklauseln der Europäischen Kommission. 5. Kontaktaufnahme

Wenn Sie mir über das Kontaktformular oder per E-Mail schreiben, verarbeite ich Ihren Namen, Ihre E-Mail-Adresse und den Inhalt Ihrer Nachricht, um die Anfrage zu beantworten. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO, wenn die Anfrage einen Vertrag betrifft, sonst Art. 6 Abs. 1 lit. f DSGVO. Die Daten lösche ich, sobald die Anfrage erledigt ist und keine gesetzlichen Aufbewahrungsfristen entgegenstehen.

 

6. Kostenlose Day-Master-Analyse und E-Mails

Wenn Sie die kostenlose Analyse anfordern, verarbeite ich Ihren Vornamen, Ihre E-Mail-Adresse und den von Ihnen gewählten Day Master. Ich nutze diese Daten, um Ihnen die Analyse als PDF zuzusenden und Ihnen gelegentlich Texte und Angebote zum Thema Timing zu schicken.

Rechtsgrundlage ist Ihre Einwilligung nach Art. 6 Abs. 1 lit. a DSGVO. Sie können diese jederzeit widerrufen, ohne dass die Rechtmäßigkeit der bis dahin erfolgten Verarbeitung berührt wird. Für den Widerruf genügt der Abmeldelink am Ende jeder E-Mail oder eine Nachricht an hello@maryannhaack.com. Nach dem Widerruf lösche ich Ihre Daten aus dem Verteiler.

Versand und Verwaltung erfolgen über die Funktionen von Wix. Ihre Anmeldung wird protokolliert, um sie im Streitfall nachweisen zu können. Rechtsgrundlage dafür ist Art. 6 Abs. 1 lit. f DSGVO.

 

7. Kostenlose Rechner auf dieser Website

Auf dieser Website finden Sie mehrere Rechner, in die Sie Geburtsdatum, Geburtszeit und Geburtsort eingeben können. Diese Angaben werden ausschließlich in Ihrem Browser verarbeitet. Sie werden nicht an mich übermittelt und nicht auf einem Server gespeichert. Sobald Sie die Seite schließen, sind sie verschwunden.

Eine Ausnahme ist die Ortssuche im BaZi Chart Generator. Dort wird Ihre Eingabe an den Dienst Nominatim der OpenStreetMap Foundation, St John's Innovation Centre, Cowley Road, Cambridge, CB4 0WS, Vereinigtes Königreich, übermittelt, um die geografischen Koordinaten des Ortes zu ermitteln. Dabei wird auch Ihre IP-Adresse übertragen. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO; mein berechtigtes Interesse liegt in der korrekten Berechnung. 8. Zahlungsabwicklung

Für kostenpflichtige Angebote nutze ich den Zahlungsdienstleister Stripe. Anbieter für Europa ist die Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Irland.

Wenn Sie einen Kauf abschließen, geben Sie Ihre Daten direkt bei Stripe ein. Dazu gehören Name, E-Mail-Adresse, Zahlungsdaten und bei der persönlichen Analyse zusätzlich Geburtsdatum, Geburtszeit und Geburtsort. Ich erhalte von Stripe die Angaben, die ich für die Erbringung der Leistung und für meine Buchhaltung brauche; vollständige Kartendaten erhalte ich nicht.

9. Terminbuchung

Für die Vereinbarung von Terminen nutze ich Cal.com. Anbieter ist die Cal.com, Inc., 2261 Market Street #4382, San Francisco, CA 94114, USA. Wenn Sie einen Termin buchen, werden Ihr Name, Ihre E-Mail-Adresse, der gewählte Termin sowie die Angaben verarbeitet, die Sie im Buchungsformular machen, insbesondere Geburtsdatum, Geburtszeit, Geburtsort und Ihre Fragen. 10. Online-Sitzungen

Gespräche und Kurseinheiten finden über Zoom statt. Anbieter ist die Zoom Communications, Inc., 55 Almaden Boulevard, Suite 600, San Jose, CA 95113, USA. Dabei werden Ihr Name, Ihre E-Mail-Adresse, Verbindungsdaten sowie Bild und Ton während der Sitzung verarbeitet. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO. Dabei werden Daten in die USA übermittelt; Zoom ist nach dem EU-US Data Privacy Framework zertifiziert und stützt die Übermittlung ergänzend auf die Standardvertragsklauseln. 11. Speicherdauer

Ich speichere personenbezogene Daten nur so lange, wie es für den jeweiligen Zweck erforderlich ist. Danach lösche ich sie, sofern keine gesetzlichen Aufbewahrungsfristen bestehen. Für Rechnungen und Buchungsbelege gelten die handels- und steuerrechtlichen Fristen von sechs beziehungsweise zehn Jahren.

 

12. Ihre Rechte

Sie haben das Recht auf Auskunft über die zu Ihrer Person gespeicherten Daten, auf Berichtigung unrichtiger Daten, auf Löschung, auf Einschränkung der Verarbeitung und auf Datenübertragbarkeit. Sie können einer Verarbeitung, die auf Art. 6 Abs. 1 lit. f DSGVO beruht, jederzeit widersprechen. Eine erteilte Einwilligung können Sie jederzeit mit Wirkung für die Zukunft widerrufen.

Außerdem haben Sie das Recht, sich bei einer Datenschutz-Aufsichtsbehörde zu beschweren. Zuständig ist für mich das Bayerische Landesamt für Datenschutzaufsicht, Promenade 18, 91522 Ansbach.

 

13. Keine automatisierte Entscheidungsfindung

Eine automatisierte Entscheidungsfindung einschließlich Profiling nach Art. 22 DSGVO findet nicht statt.

 

14. Änderungen

Ich passe diese Datenschutzerklärung an, wenn sich die angebotenen Leistungen oder die Rechtslage ändern. Es gilt jeweils die auf dieser Seite veröffentlichte Fassung.
